The Failure of the 28-Clause Peace Proposal for Ukraine: How Diplomatic Efforts Continue to Stumble

Europe felt a moment of respite on Monday, as the tension caused by the presentation of a new 28-article proposal for ending the war appeared – briefly – to have been defused. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Moscow made its response: a renewed assault of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of contrasting events captured the harsh reality of the current period. By day, political struggles are conducted: hopeful statements are issued from multiple capitals. Considerable effort is devoted on managing specific proposals. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "peace".

Nighttime Reality

As the offensive unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was exposed. Ukraine is capable of detecting rocket firings from across the border, a ability afforded by up-to-date information. From observation points, military aircraft that had been scrambled to engage hostile aerial threats flew past – sophisticated military planes supplied to Ukraine by European allies.

Moments later, Kyiv's missile defense thundered: defensive missiles deployed against a incoming threat. This was a modern interception technology at work, presumably delivered by partner states. Every launch shakes the surroundings, causing tremors. The moment of terror quickly becomes resigned acknowledgment: maybe the approaching threat won't strike its target this time, preventing destruction from devastation and further power outages.

Persistent Threats

Soon after, a large-caliber weapon fired at a unmanned aircraft in the vicinity, part of a rapid response unit – most likely imported technology. Sadly, the bullets missed the opposing UAV – it continued its flight toward its objective.

Periodically, this persisted until dawn. Kyiv faced the early updates: seven people killed, destruction and infrastructure problems in numerous residences as a result of the night's assault. As always, everyone still maintained normal activities – experiencing conflict. But those full day demonstrated Ukraine's critical military reliance on international aid – a reliance that European nations are clearly incapable to replace in the short term.

Ineffective Peace Efforts

The 28-point plan from Washington sparked intense emotion, debate and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new proposal from American administration unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually secure success. This trend will, undoubtedly, continue.

Strategic Calculations

It is tempting to accuse specific actors of consistently pushing Moscow's conditions. But that does not seem to be the entire situation. US administration works based on a assumption well known to seasoned negotiators: you cannot secure via talks what you have been unable to protect through force. The US administration presumes that it is unfeasible to pressure the Kremlin to surrender the territory that it presently holds in Ukraine's occupied territories.

The problem is that while acknowledging this situation, US leadership does little to discourage Russia, through diplomacy or military means, from believing that the status quo will not change more in its benefit in the near future.

Opposing Positions

Therefore, Moscow is convinced that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their reason to accept conditions that does not give them the largest achievable advantage is close to zero. There may be many attempts to achieve ceasefire, but they will continue as long as Russia's leadership remains highly assured in the result.

On the contrary, Kyiv believes that Ukraine can still persist, progressively conceding civilians and areas but preventing a complete military breakdown until situations evolve in its advantage.

Current Realities

Objectively, there are no real preconditions for a armistice. Now, individual motivations are coming into play: personal goals to mediate resolution and achieve global acclaim, and Kyiv's twin challenges – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the national cause against any initiative Kyiv finds unacceptable, so that their focus does not move to homefront challenges. And although their objective will now be significantly challenging after latest incidents, it remains very improbable that this will modify their basic position.

These opposing factors are driving the talks.

Assessment and Future

It took a only one week to terminate the suggested clauses of the most recent proposal. Assertive and inconsistent approach of the matter by Washington, resistance by Ukraine and the other European countries, along with calming attempts of negotiators, and finally, recent disclosures, all did their job.

While new proposals based on previous concepts are imminent, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and demonstrate certain reluctance to modify developments, if they stand together and improve their protective measures at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the coming months, mainly require continued Western support.
